The Party Wall Act of 1996 provides a framework for preventing and resolving disputes in relation to party walls, boundary walls, and excavations near neighbouring buildings. It is designed to ensure that building works carried out by one property owner do not negatively impact the adjoining property or its owners.

Notices: If you intend to carry out works covered by the Act, you must serve a formal notice to your neighbour. This includes work on existing party walls, the construction of new walls at boundaries, and excavation near neighbouring properties.
Response Time: Adjoining owners have 14 days to respond to a notice. If they consent, work can proceed. If they dissent or do not respond, a dispute is deemed to have arisen, requiring the appointment of a surveyor.
Surveyors: In case of a dispute, both parties can agree on a single surveyor (an agreed surveyor) or each appoint their own. The surveyor(s) will then draw up a party wall award outlining the work to be done, how and when it will be carried out, and any necessary protective measures.
